Terms of Use
These terms are the agreement between you and Session when you use our website, apps and booking service. We have tried to keep them short and plain. By creating an account or using Session, you agree to them.
Effective [Effective date] · Contact: Mitchcelayatattoos@gmail.com
1. About Session
Session is operated by Mitchell Celaya. It is a subscription service that helps tattoo artists manage booking inquiries: conversations, intake details, approvals, deposit requests and calendar availability. In these terms, “we” and “us” mean Session, and “you” means the artist or studio using it. People who message you through Session are your “clients.”
2. Your account
- You must be at least 18 and able to enter a contract to create an account.
- Give accurate information and keep it up to date.
- Keep your sign-in details private. You are responsible for what happens under your account, including actions by people you invite.
- Tell us promptly at Mitchcelayatattoos@gmail.com if you think someone else has accessed your account.
3. Acceptable use
Use Session only for your own lawful tattoo booking business. Do not:
- send spam, unsolicited marketing or messages to people who have asked you to stop;
- harass, threaten or mislead anyone, or impersonate another person or business;
- upload unlawful content or content you do not have the right to use;
- break the rules of connected services such as Instagram, SMS carriers, calendar providers or Stripe;
- try to access other accounts, probe or disrupt the service, or copy or resell it.
We may limit or suspend messaging if we see activity that puts clients, carriers or the service at risk.
4. Your clients and their information
You decide which clients you work with and what information you collect from them. You are responsible for having a lawful basis to message your clients and to store their details, photos and booking records in Session, and for meeting the privacy, consent, age and health-record rules that apply to your studio.
We handle that information to provide the service, as described in our Privacy Policy. You can delete conversations in Session, and you can ask us to delete your account at any time.
5. AI replies are drafts you are responsible for
Session can write replies, summaries and booking suggestions using AI, based on your settings and the conversation. AI can be wrong. Treat every AI reply as a draft written on your behalf.
If you turn on automatic replies or automatic approval, Session sends messages and approves requests for you within the rules you set, and you are responsible for those messages as if you had sent them yourself. Check your settings, review conversations and take over whenever you need to.
6. Deposits and payments between you and your clients
Deposits and payments for tattoo work are between you and your client. Session can send a deposit request or payment link and track what you record, but we are not a party to that transaction, we do not hold client funds, and we are not responsible for refunds, chargebacks or disputes between you and your client. Payments made through Stripe are also covered by Stripe's terms.
Confirm a payment has actually arrived before you rely on it. A screenshot from a client is not proof that funds have settled.
7. Subscription, billing and cancellation
- Session is billed monthly in advance at the price shown on our pricing page when you subscribe, plus any applicable taxes. Billing is handled by Stripe.
- Your subscription renews each month until you cancel.
- You can cancel at any time from Plan & billing in your settings, or by emailing us. Unless we tell you otherwise when you cancel, cancellation takes effect at the end of the current billing period and you keep access until then. We do not give refunds for partial months unless the law requires it.
- Deleting your account does not cancel your subscription by itself. Cancel your subscription in Plan & billing first, or tell us when you ask for deletion.
- If we change the price, we will tell you at least 30 days before it applies to your next billing period. You can cancel before then.
8. Ending the service
You can stop using Session and ask us to delete your account at any time. We may suspend or close an account that breaks these terms, puts others at risk or goes unpaid. Where it is reasonable, we will tell you first and give you a chance to fix the problem.
When an account is closed, messaging stops and connected services are disconnected. Sections 4 to 6 and 9 to 12 continue to apply after the account ends.
9. Disclaimers
We work to keep Session reliable, but it is provided “as is” and “as available.” We do not promise that it will be uninterrupted or error-free, that every message will be delivered, or that it will bring you a particular number of bookings. Connected services such as Instagram, SMS carriers, calendars and Stripe are outside our control. To the extent the law allows, we disclaim all other warranties, including fitness for a particular purpose.
10. Limitation of liability
To the extent the law allows, Session is not liable for indirect, incidental or consequential losses, such as lost bookings, lost profits or lost data. Our total liability for any claim about the service is limited to the amount you paid us in the 3 months before the claim arose. Nothing in these terms limits liability that cannot be limited by law.
11. Governing law
These terms are governed by the laws of the State of [State], without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in [State], unless the law where you live requires otherwise.
12. Changes and contact
We may update these terms as Session changes. We will post the new version here with its effective date and tell you in advance about significant changes. If you keep using Session after a change takes effect, the updated terms apply.
Questions about these terms can be sent to Mitchcelayatattoos@gmail.com.
